| 孝和仁是儒家伦理体系的核心范畴，其概念内涵及其相互关系构成了儒家道德哲学的重要议题。从思想史的脉络考察，孔子对传统孝道进行了创造性转化，一方面消解孝道的宗法政治属性，赋予其以“爱”和“敬”为本的自然属性；另一方面，孔子的哲学创新还在于通过对仁的哲学提升，实现了仁从特殊伦理到普遍伦理的范式转换。在孝仁关系上，孝作为基于血缘的自然情感，构成仁德的现实基础；仁作为普遍的伦理准则，则为孝提供终极的价值依托。而由孝及仁的过程，也是通过忠恕之道的推扩机制，整合家、国、天下的互动过程。然而，这一理论架构在现实中面临的核心困境，集中体现于“父子相隐”所引发的伦理争议：“父子相隐”究竟是基于天理人情，还是会走向悖德乱法？本文以容隐制度为分析个案，试图为孝仁关系的矛盾提供建设性的解释方案。 |

| Filial piety and benevolence stand as the core categories of the Confucian ethical system, and their conceptual connotations and interrelationship constitute a central issue in Confucian moral philosophy.From an intellectual-history perspective, Confucius initiated an innovative transformation of traditional filial piety. He disassembles the patriarchal-political attributes within filial piety, endowing it with love and reverence as its natural attributes; simultaneously, he promotes benevolence, expanding it from a particular kin group to a universal paradigm. Within the filial-piety-benevolence nexus, filial piety, as a natural emotion rooted in blood ties, provides the existential basis for benevolence, while benevolence, as universal ethics, supplies the ultimate value orientation for filial devotion. The progression from filial piety to benevolence can be understood as an interactive process among family, nation, and world, conceptualized through the expansion mechanism of loyalty and forgiveness. Yet this theoretical framework faces practical dilemmas, most notably evident in the ethical controversy surrounding fathers and sons concealing one another’s misconduct. This paper examines whether the principle of paternal – filial concealment embodies heavenly principle and human sentiment, or whether it undermines moral and legal order. By analyzing kinship concealment as a case study, the paper proposes a constructive resolution to the theoretical tension between filial piety and benevolence. |
