| 犯罪数额是刑法的重要要素，关联着犯罪的定性和定量，刑法离不开犯罪数额。应从狭义和广义两个层面理解和把握犯罪数额的内涵，以及从类型化明晰犯罪数额的内在要素。犯罪数额的类型包括：纯正的犯罪数额和不纯正的犯罪数额，立法数额和司法解释数额，基本犯数额和加重犯数额。犯罪数额表明着某些犯罪的社会危害性，反映着行为违法性程度，以及行为人的人身危险性等犯罪特征，成为数额犯范畴内判断构罪与否及衡量责任大小的主要标准。正确看待犯罪数额和准确把握犯罪数额有助于保障和提升刑事司法公正。 |

| The amount of crime is an important element of criminal law, which is related to the qualitative and quantitative analysis of crime. Criminal law is unseparable from the amount of crime. The connotation of the amount of crime can be understood and grasped in the narrow and broad senses, and its internal elements can be clarified in terms of typology. The types of crime amount include: pure and impure crime amount, legislative and judicial interpretation amount, basic crime and aggravated crime amount. The amount of crime indicates the social harmfulness of some crimes, reflects the degree of illegality of behavior, and the personal danger of the perpetrator. A correct view of the amount of crime and an accurate grasp of the amount of crime is conducive to the protection and promotion of criminal justice. |
