| 农地三权分置制度与股份合作制契合的前提是，合理确定承包权和经营权的性质和权能。农民以经营权换取合作社的股权，合作社则赋予农民股权为对价取得完整且可自由让渡的经营权；农民还可依承包权从合作社获取固定收益，取得债权人地位，且其债权顺位应优先。“股权＋债权"的制度设计反映了多地”保底＋分红”的实践需求，可成为解决农民生存保障和土地适度规模经营矛盾的优选制度。 |

| The consistency between the separated agricultural land right system and the share cooperative is possible only when the nature and function of the contractual right and the management right is reasonably defined. Peasants receive equities from the cooperative services who obtain the complete and free transferable right of management as return of its recession in equity. The peasants also receive fixed incomes in accordance with his contractual right and established his status as a creditor of priority debts. The system design of "equity and creditor's right" reflects peasants' practical demands for "guarantee of bottom and profits", which can serve as a premium institution for settling the contradicts between guarantee of peasants' livelihood and on-scale operation of land. |
