| 契约已成为当代人重要的行为方式,但契约领域还存在某些失范现象,因此需要提倡契约和谐,以减少人生情绪成本,增加社会幸福元素。就现实性来看,契约和谐具有三重意蕴,即契约特殊意志自身的和谐、契约特殊意志与特殊意志之间的和谐、契约合意与契约意志的和谐。实现契约和谐的伦理路径在于通过抽象而具象、通过道德哲学而走向伦理实践,它要求契约主体以内心的道德觉悟正确处理"义利关系"、"人我关系"和"公私关系",在世俗的"契约生活态势"中坚守道德光明之路。 |

| Contract has been an important contemporary human behavior. Nevertheless, certain anomie phenomena exist in contract filed, which call for contractual harmony that reduces life emotion costs and increases social well-being. Realistic contractual harmony is of triple implications, namely, harmony in particular contractual wills, harmony between particular wills, and harmony between contractual agreement and contractual wills. The approach to realizing contractual harmony hes in one from＇ abstract to concrete, from moral philosophy to ethical practice. It requires that the contractual subjects have right moral conscience in dealing with the relationship between justice and benefit, between others and ego and between public and private, thus he can adhere to a moral and shining way of secular ＂contractual life＂ |
