| 一般认为企业合约实施表现为自我实施,但从实施角度研究企业合约的性质,我们提出企业合约实施的状态依存,即在不同情况下或不同层面上,企业契约表现为不同的实施形态,企业在本质上是要素合约的一种实施机制。契约的实施路径较之契约的形式可能比较适宜证伪张五常。 |

| This article discusses the nature of firm contracts from the view of enforcement.Firm contract enforcement is generally believed to be realized in a self-enforcing way.In this paper,it is argued that firm contract enforcement is situation-dependent in other words,firm contracts are enforced differently under different situations or at different dimensions.Firm is in nature a system of essence contracts.Compared with forms of contracts,the enforcement approaches would be a tool more convenient to falsify the theory of Steven N.S.Cheung. |
