| 中国传统治国理政思想肇端于先秦。在先秦时期,德刑观是治国理政的重点和核心。从本体论的维度看,由天人合一的理念生发出了春夏有赏、秋冬行刑的德刑观;从人性论的维度看,性善与性恶决定了德刑观的不同指向;从法伦理的维度看,刑罚尚中体现了德刑观的价值取向;从实践论的维度看,明德慎罚凸显了政法实践活动中的内在调适;从教化论的维度看,儒家的礼乐教化和刑教等教化理论构成了德刑观的社会矫正内核;从影响论的维度看,明德慎罚、德礼刑政的先秦德刑观不仅对当时的政治生活和社会生活起到了重要的作用,而且其治国理政观念及制度设计还深刻影响着秦汉直至清末的整个中国传统社会时期的政治和法律体系建构,成为秦汉以降中国封建社会德主刑辅、德刑兼施政法理念的型范。 |

| China's traditional governance thoughts began in the pre-Qin period, in which the relationship between morality and the punishment became the core. From the ontological perspective, the theory of Nature and Man in One is originated from the morality and punishment theory in which the reward is granted in spring and punishment in autumn. From the theory of human nature, relationship of morality and punishment is based on the view of human being inherently kindness or human evil. From ethic perspective, the value of morality and punishment is represented in the moderate punishment. From practical perspective, advocating morality and cautious punishment symbolize the inner adjustment of law enforcement. From educative perspective, the etiquette education and criminal punishment in Confucianism represent core value of social reformation. The concept of morality and punishment in pre-Qin has exerted far-reaching influence on the social and political life at that time, and on the political and legal system of the Chinese traditional society from Qin and Han Dynasties to the late Qing Dynasty. |
